Case Background

On June 1, 2020, Libbey and its U.S.-based subsidiaries filed voluntary petitions for a court-supervised reorganization under Chapter 11 of the U.S. Bankruptcy Code in the U.S. Bankruptcy Court for the District of Delaware.  Libbey expects to use the court-supervised restructuring process to strengthen its balance sheet, to navigate the effects of the COVID-19 pandemic, and better position the Company for the future. 

On December 29, 2020, the Court entered a Final Decree closing 11 of the Debtors' 12 cases (the "Closed Cases").  Going forward, all matters relating to any of the Debtors or the Reorganized Debtors shall be administered under the case of LGA3 Corp. (Case No. 20-11456).

Libbey is continuing constructive discussions with its lenders and other stakeholders regarding the terms of a consensual financial restructuring plan and is focused on achieving a resolution as expeditiously as possible. The Chapter 11 process only relates to Libbey’s U.S.-based business and does not include its international subsidiaries in Canada, China, Mexico, the Netherlands and Portugal, which are operating in the normal course of business.

The Company is continuing to serve customers and end users globally, providing an extensive line of high-quality glassware and other tabletop products. In connection with the Chapter 11 filing, Libbey has received a commitment for up to $160 million in debtor-in-possession (“DIP”) financing from its current lenders, including a $100 million revolving credit facility and a $60 million term loan. Following court approval, the Company expects this financing, together with cash flow from operations, to support the business during the court-supervised process.

Libbey’s case has been assigned to the Honorable Laurie Selber Silverstein.

Important Information & Dates

Plan and Disclosure Statement

On August 21, 2020, the Debtors filed their Chapter 11 Plan of Reorganization and the Disclosure Statement related thereto. On August 24, 2020, the Bankruptcy Court entered an order approving the Disclosure Statement. The Bankruptcy Court has held a hearing to consider confirmation of the Plan on October 19, 2020 at 10:00 a.m. (ET). On October 20, 2020, Bankruptcy Court entered an order confirming the Plan.  On November 13, 2020, the Plan became effective.

Deadline to File Claims

The Bankruptcy Court has set the following deadlines for filing proofs of claim:

• General Bar Date: August 10, 2020, at 5:00 p.m. (ET)
• Governmental Bar Date: November 30, 2020, at 5:00 p.m. (ET)
• Administrative Claims Bar Date: December 16, 2020, at 5:00 p.m. (ET)

First Day Hearing
