Case Background
On July 1, 2019, Blackjewel, L.L.C. and four affiliated debtors (collectively, the "Debtors") each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Southern District of West Virginia. The cases are pending before the Honorable Frank W. Volk and are jointly administered under Case No. 19-30289.
On July 24, 2019, six additional debtors each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Court for the Southern District of West Virginia.
Important Information & Dates
Temporary Stay of Collection Actions Related to Health Plan Claims
On March 22, 2021, the Court entered and order continuing the stay temporarily prohibiting medical service providers from direct billing and/or commencing or continuing any judicial, administrative, or other proceeding against individuals covered under the Debtors' health plan through the earlier of March 31, 2021, or the Effective Date of the Debtors’ Plan. On March 26, 2021, the Debtors filed a motion [Docket No. 3191] seeking a further extension of the stay. At the hearing on March 31, 2021, at 2:00 p.m. (prevailing Eastern Time) the Court considered a further extension of the temporary stay. On April 2,2021 the Court entered and order continuing the stay temporarily prohibiting medical service providers from direct billing and/or commencing or continuing any judicial, administrative, or other proceeding against individuals covered under the Debtors' health plan.
Order Partially Granting Temporary Stay
Plan & Disclosure Statement
On September 25, 2020, the Debtors filed their Joint Plan of Reorganization and the Disclosure Statement related thereto. The hearing to consider confirmation of the plan and approval of the disclosure statement was held on December 17, 2020 at 9:30 a.m., prevailing Eastern Time. On March 22, 2021, Bankruptcy Court entered an order confirming the plan. On April 1, 2021, the Effective Date of the Plan occurred, and the Plan was consummated.
