Case Background

On November 10, 2015, East Orange General Hospital, Inc. and Essex Valley Healthcare, Inc. (collectively, the "Debtors") each filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of New Jersey.  The cases are pending before the Honorable Vincent F. Papalia and are jointly administered under Case No. 15-31232.

Plan and Disclosure Statement

On June 28, 2016, the Debtors and the Official Committee of Unsecured Creditors (the “Committee”) filed their Joint Plan of Liquidation (the “Plan”) and Disclosure Statement for Joint Plan of Liquidation (the “Disclosure Statement”).  By order entered on July 13, 2016 (the “Combined Hearing Order”), the Bankruptcy Court conditionally approved the Disclosure Statement and authorized the Debtors and the Committee to solicit votes to accept or reject the Plan. 

Holders of claims in Class 5 under the Plan will receive a ballot form (the “Ballot”) to vote to accept or reject the Plan.  As more fully set forth in the Combined Hearing Order, in order to be counted as a vote to accept or reject the Plan, a Ballot must be properly executed, completed and delivered by U.S. Mail, courier or overnight delivery, so that such Ballot is actually received by Prime Clerk LLC (now known as Kroll Restructuring Administration) (the balloting agent) by no later than August 15, 2016 at 5:00 p.m. (prevailing Eastern Time), at the following address:

A hearing to consider final approval of the Disclosure Statement and confirmation of the Plan was held before the Honorable Vincent F. Papalia, United States Bankruptcy Judge, in Courtroom 3B of the United States Bankruptcy Court for the District of New Jersey, 50 Walnut Street, 3rd Floor, Newark, New Jersey 07102, on August 23, 2016 at 2:30 p.m. (prevailing Eastern Time), or as soon thereafter as counsel may be heard.

Any objections to final approval of the Disclosure Statement or confirmation of the Plan must be filed and served in accordance with the Combined Hearing Order by August 15, 2016.
