Important Information & Dates
Title III of the Puerto Rico Oversight, Management, and Economic Stability Act ("PROMESA") provides a means for a covered territory (such as the Commonwealth) that has encountered financial difficulty to work with its creditors to adjust its debts. To that end, certain sections of the United States Bankruptcy Code, 11 U.S.C. § 101 et seq., are incorporated and made applicable to cases under Title III of PROMESA. During the Title III Case, the Commonwealth will remain in possession and control of its property, and will continue to maintain its functions and provide services for the benefit of the citizens of Puerto Rico.
The HTA Plan
On June 22, 2022, the Court entered an Order approving the Disclosure Statement for the Third Amended Title III Plan of Adjustment of the Puerto Rico Highways and Transportation Authority, dated June 17, 2022. The hearing to consider confirmation of the Third Amended Title III Plan of Adjustment of the Puerto Rico Highways and Transportation Authority (the “Plan”) is scheduled for August 17-18, 2022 at 9:30 a.m. (AST). The Commonwealth, ERS, and PBA Plan
On August 2, 2021, the Court entered an Order approving the Disclosure Statement for the Seventh Amended Title III Joint Plan of Adjustment of the Commonwealth of Puerto Rico, et al., filed by the Commonwealth, Employees Retirement System of the Government of the Commonwealth of Puerto Rico ("ERS"), and Puerto Rico Public Buildings Authority ("PBA"). On January 14, 2022, the Commonwealth, ERS, and PBA filed the Modified Eighth Amended Title III Joint Plan of Adjustment of the Commonwealth of Puerto Rico, et al. On January 18, 2022, the Court entered an Order confirming the Plan. On March 15, 2022, the Effective Date of the Plan occurred, and the Plan was consummated.

El Título III de la Ley de Supervisión, Administración y Estabilidad Económica de Puerto Rico (Puerto Rico Oversight, Management and Economic Stability Act, «PROMESA») prevé un mecanismo para que un territorio comprendido (como es el Estado Libre Asociado) con dificultades financieras para trabajar negocie con sus acreedores un ajuste de sus deudas. Para tal fin, determinadas secciones del Código de Quiebra de los Estados Unidos, el Artículo 101 et seq. del Título 11 del Código de los Estados Unidos (United States Code, U.S.C.), se incorporan y se hacen aplicables a los casos al amparo del Título III de la PROMESA. Durante el Caso al amparo del Título III, el Estado Libre Asociado mantendrá la posesión y el control de sus bienes, y continuará desempeñando funciones y prestando servicios en beneficio de los ciudadanos de Puerto Rico.
El Plan ACT
El 22 de junio de 2022, el Tribunal emitió una Orden aprobando la Declaración de Divulgación del Tercer Plan de Ajuste Enmendado del Título III de la Autoridad de Carreteras y Transportación de Puerto Rico, con fecha 17 de junio de 2022. La audiencia para considerar la confirmación del Tercer Plan de Ajuste Enmendado del Título III de la Autoridad de Carreteras y Transportación de Puerto Rico (el “Plan”) está programado para el 17 y 18 de agosto de 2022 a las 9:30 a. m. Plan del Estado Libre Asociado, ERS y AEP
El 2 de agosto de 2021, el Tribunal dictó una Resolución que aprobaba la Declaración Informativa correspondiente al Séptimo Plan Conjunto de Ajuste Enmendado al amparo del Título III del Estado Libre Asociado de Puerto Rico y otros, presentado por el Estado Libre Asociado, el Sistema de Retiro de Empleados del Gobierno de Puerto Rico y la Autoridad de Edificios Públicos de Puerto Rico (en conjunto, los “Deudores”). El 18 de enero de 2022, el Tribunal dictó una Resolución que confirma el Plan. El 15 de marzo de 2022, ocurrió la Fecha Efectiva del Plan y se consumó el Plan.
